Stop-and-Frisk in New York

If you were stopped by police in New York City, the legality of that encounter may be one of the most important issues in your case. Under New York Criminal Procedure Law § 140.50, officers are allowed to stop and briefly detain a person in public only when they have reasonable suspicion that the person has committed, is committing, or is about to commit a crime. They may conduct a limited pat-down (a “frisk”) only if they reasonably believe the person is armed and dangerous.

Reasonable Suspicion

“Reasonable suspicion” is more than a hunch—it must be based on specific, articulable facts. Courts closely examine whether the officer can point to clear observations that justified the stop. Vague claims like “acting suspicious” or simply being in a high-crime area are often not enough on their own.

An unlawful stop can have a major impact on your defense. If police violated your rights during the encounter, your attorney can file a motion to suppress evidence. This means that any evidence found during the stop, such as drugs or a weapon, may be excluded from court. Additionally, statements you made may also be suppressed. As a result, the prosecution’s case can be significantly weakened—or even dismissed entirely.

Challenging an Illegal Stop

A strong defense will carefully analyze what the officer observed before stopping you, whether the level of police intrusion was justified, whether the frisk was legally permitted, and whether your constitutional rights were violated. New York courts take these issues seriously, especially given the long history of litigation surrounding stop-and-frisk practices in New York City.
